PRINCIPAL ACCOUNTABILITIES: 1. Provide guidance, coaching and advice to management on associate relations. This would include but is not limited to performance counseling and documentation, performance reviews, suspensions and terminations. As necessary provide associates with support, guidance, constructive perspective and understanding on matters relating to disciplinary actions and terminations. 3. Analyze the level of risk and assess the legal and cultural ramifications including the establishment of any precedents and exposure to the company in the course of dealing with any associate relations issue. Ensure positive employee relations through equitable, consistent and correct application and administration of all company policies and procedures and compliance with all state and federal laws. 4. Review and investigate all discrimination, harassment, and wrongful termination claims filed individually or through a state or federal agency. This includes DOL Wage and Hour Audits and OSHA complaints. Work with legal counsel and appropriate company management to direct the research, documentation, deposition(s) and compilation of all necessary facts required for the preparation of the appropriate correct response and the successful resolution of the matter. 5. Conduct feedback meetings with groups of associates to gather an independent and confidential consensus of opinions on matters relating to any number of factors including supervision, management style, communication, benefits, leadership, pay, work environment, morale, etc. These feedback meetings may be in response to comments or letters expressing certain concerns or regularly scheduled periodic meetings. Results should be summarized and shared with appropriate management. 6. Track and investigate turnover; conduct exit interview with selected exempt and non-exempt associates. Prepare summary for management review. Review, investigate and follow up on exit interview questionnaires and letters from current and former associates. 7. Manage unemployment claims, research and contest as necessary. Provide information and documentation regarding the reasons for termination. Work with appropriate company management and outside U/C cost control company, Talx UCeXpress in the processing and preparation of documents for determination hearings and appeals. Provide coaching guidance and counsel to company management that may be required to attend these hearings. 8. Design and administer training programs to management on matters relating to performance management, performance counseling and terminations. Provide on going, day to day counsel/training on how to plan for, prepare, document and conduct warnings and other sensitive performance discussions. 10. Authorize, review and communicate results of pre-employment external credit and criminal background check for all final candidates for positions in the company s I.S. departments. Ensure compliance with the Fair Credit Reporting Act (FCRA) on all authorizations and communications. 11. Maintain and update counseling notes and actions in Talbots Case Management file or Exit Interview file on-line in PeopleSoft database system. 12. Provide assistance and support on other sensitive and confidential projects as directed and assigned. Assist in the planning and implementation of Activities Committee functions and other activities, i.e., service recognition, picnic, holiday party, etc. A Bachelors Degree and a minimum of six to eight years of human resource generalist experience with specific working knowledge in the area of employee relations, mediation, problem resolution and investigatory research. Previous experience in dealing with sensitive legal claims such as harassment, discrimination charges, wrongful termination claims and unemployment hearings and a working HR knowledge of applicable labor laws.
